Terms of Service.
The terms that govern bookings, sessions, image usage and delivery for Martin Mills Photography — written plainly so you know what to expect before you book.
Last updated: 2 November 2026
1. These terms
These terms set out the agreement between you (the “Client” or “you”) and Martin Mills Photography (“we”, “us” or the “Studio”) for portrait, social media content and aerial photography services. By booking a session, submitting an enquiry, or paying a deposit, you accept these terms in full.
We may update these terms from time to time. The version that applies to your booking is the version current on the date your session is confirmed.
2. What we deliver
We provide photography services across three disciplines: portraits and headshots, social media content days, and aerial (drone) work. Each package specifies the session length, number of retouched files and turnaround we include. Anything outside that scope is quoted separately and agreed in writing before the session.
Creative direction — the look, lighting and mood of the images — is at our discretion unless we agree otherwise in your brief. We always aim for the brief, but photography is a creative service and final results are not guaranteed to match a specific reference image.
3. Bookings, deposits & payment
A booking is confirmed only once a deposit is received and a date is agreed in writing. The deposit reserves your date and covers pre-production planning. Deposits are non-refundable but are credited toward the total balance of your package.
The remaining balance is due on, or before, delivery of your final images unless we agree a different arrangement. For larger or commercial shoots, staged invoicing may apply. Invoices are payable in Australian dollars (AUD) and are due within 7 days unless stated otherwise.
4. Rescheduling & cancellations
Life happens. You can reschedule once without charge provided you give us at least 48 hours’ notice. With less than 48 hours’ notice, a rescheduling fee may apply to cover crew and location commitments already made.
If you cancel after confirming, the deposit is forfeited to cover the time we reserved for you. If we need to reschedule for any reason, we will offer you alternative dates at no cost.
Weather affects aerial and outdoor sessions. If conditions make a shoot unsafe or unusable, we will reschedule at no cost and work with you to find the next suitable window.
5. On the day
You agree to arrive on time and to come prepared — styled, briefed and ready to shoot as agreed. We handle the rest, including location, logistics, lighting and direction.
You are responsible for any permits, location fees or access approvals required for your chosen location. We can advise on these, but they are billed to you unless we agree otherwise.
6. Image usage & licensing
On final payment, you receive a licence to use the delivered images for personal and standard commercial purposes — including social media, websites, print collateral and portfolio use — for the entity named on your invoice, in perpetuity, within Australia and internationally.
Unless agreed in writing, this licence does not include: resale of the images as standalone files, transfer or sub-licensing to third parties, use in endorsements not disclosed at the time of booking, or use in ways that defame or misrepresent the subject. For advertising campaigns, broadcast or large-scale merchandising, an extended licence can be arranged.
We retain copyright in all images at all times. The licence is personal to you and is non-transferable without our written consent.
7. Retouching & delivery
Every delivered frame is hand-retouched and colour-balanced. The number of retouched files is set by your package; additional retouched files can be purchased at the rate quoted on your invoice. Standard turnaround is noted in your package; rush turnaround is available on request and may carry a fee.
Images are delivered digitally via the Client Portal or a secure gallery link. Raw or unedited files are not included and are not available for release, except where agreed for commercial or editorial work.
8. Subject permissions
All photographs displayed on this site are used with the full permission of the subject(s). For your own session, you are responsible for ensuring you have permission from anyone who appears in the images (for example, colleagues, friends or family) for the intended use.
Where minors are photographed, a parent or legal guardian must consent on their behalf.
9. Portfolio & marketing use
Unless you tell us otherwise in writing before or at the time of booking, we may display selected images from your session in our portfolio, on our website and social channels, and in award entries or print. You can opt out of any or all of these uses at any time — just let us know and we will remove or withhold them.
A model or talent release can be provided on request where a client needs it for their own records.
10. Limitation of liability
We take every reasonable care with your session and your data. To the extent permitted by law, our liability is limited to the amount you paid us for the session giving rise to the claim. We are not liable for indirect or consequential loss, or for matters outside our control (such as third-party platform failures, force majeure, or data you failed to provide).
Where a non-excludable right exists under Australian consumer law, nothing in these terms limits or excludes that right.
11. Governing law
These terms are governed by the laws of Queensland, Australia. Any dispute arising will be resolved in the courts of Queensland or, where applicable, the Federal Court of Australia.
